Parties to the contract
This holiday rental agreement is entered into between:
| Landlord | AZUL-ALAVA SL, with tax ID (CIF) B01244714, registered address at Plaza Amarica, 4, Vitoria-Gasteiz (01005), Araba/Álava, Spain, hereinafter “CalpeMar”. |
| Tenant | The individual or legal entity making the booking, hereinafter “the Guest”, acting in their own name or on behalf of the group of people who will occupy the accommodation. |
Purpose of the contract
The purpose of this contract is the temporary granting of the use of a holiday apartment located in Calpe (Alicante), duly registered in the Register of Tourism Companies, Establishments and Professions of the Valencian Community, for exclusively tourist and holiday use, and in no case may it be considered the tenant’s habitual residence.
The holiday rental is governed by Article 5.e) of Law 29/1994, of 24 November, on Urban Leases, and by the regional regulations of the Valencian Community regarding tourist accommodation.
Duration and stay period
- The minimum stay is 3 nights in high season (July and August) and 2 nights for the rest of the year.
- The maximum stay permitted without formalising a long-term contract is 31 consecutive days.
- Check-in will be from 15:00 on the day of arrival.
- Check-out must be completed before 11:00 on the day of departure.
- Arrivals or departures outside these hours must be agreed in advance and may be subject to an additional charge.
Price, payment method and included costs
The rental price includes: water, electricity and gas supplies within reasonable use, high-speed WiFi access, bed linen and bath towels, and final cleaning of the apartment.
Not included in the price: beach towels, mid-stay cleaning service (available as an additional service), cot or extra bed, or parking unless expressly stated in the accommodation description.

| Security deposit | €150 depending on the apartment, refundable within 7 days after check-out, subject to inspection of the accommodation. |
Cancellation policy
| Free cancellation | Up to 30 days before the check-in date: refund of 100% of the amount paid. |
| Partial cancellation | Between 15 and 29 days before: refund of 50% of the amount paid. |
| No refund | Less than 15 days’ notice or in the event of no-show: no refund will be issued. |
| Force majeure | In the event of duly evidenced force majeure (serious illness, death of an immediate family member), each case will be reviewed individually. |
| Cancellation by CalpeMar | In the unlikely event that CalpeMar must cancel the booking, 100% of the amount paid will be refunded and alternative accommodation of equal or higher category will be offered where possible. |
Occupancy, house rules and coexistence
The maximum number of occupants may not under any circumstances exceed the maximum capacity indicated in the description of each apartment. Failure to comply with this rule will entitle CalpeMar to terminate the contract with no right to a refund.
- It is expressly forbidden to hold parties, events or gatherings that exceed the maximum authorised occupancy.
- Smoking is not permitted inside the apartments. Smoking is permitted on terraces and in outdoor areas.
- Pets are not allowed unless expressly stated in the accommodation description.
- Quiet hours (22:00–09:00) must be respected at all times, in accordance with local coexistence regulations.
- The Guest is responsible for keeping the apartment in reasonably tidy and clean condition during their stay.
- Total or partial subletting of the accommodation is prohibited, including via third-party platforms.
- Any damage or breakage caused during the stay will be deducted from the security deposit or invoiced to the Guest.
Guest registration
In compliance with Royal Decree 933/2021, of 26 October, on documentary registration and information obligations for individuals staying in hospitality establishments or tourist accommodation, the Guest must provide the details of all occupants over 14 years of age before or at check-in. This information will be communicated to the State Security Forces and Corps within the legally established time limits.
Liability
CalpeMar is not liable for personal injury or material damage arising from improper use of the accommodation or its facilities, nor for the theft of the Guest’s personal belongings. Travel insurance is recommended.
CalpeMar declares that all accommodations comply with current regulations on safety, habitability and tourism in the Valencian Community.
Applicable law and jurisdiction
This contract is governed by Spanish law. For the resolution of any dispute arising from this contract, the parties submit to the Courts and Tribunals of Alicante, expressly waiving any other jurisdiction that may apply, without prejudice to consumers’ rights under consumer and user protection regulations.
